State according to the US Constitution and it’s clearly stated and limited powers of and role for the federal government, and more specifically the 10th amendment that states all powers not delegated to the federal government is then reserved for the states and its citizens.

There is no expressly written power in the Constitution allowing the federal government to ban, regulate, or allow marijuana use, selling, or the growing of.

I personally think the states should make the decisions myself. However the Federal Government has a Constitutional right to regulate medical marijuana based on the Commerce Clause and the Due Process Clause of the 14th Amendment.
